``Didn`t RP state (many times) in the past that APS did not have exclusivity on the DigEplayer?``

He did; He did many times...Indeed, that is the reason why

it is suspect that RP would sing any document that would give them ``EXCLUSIVE RIGHT TO OUR IP``...

Notice what they say in their complaint:...``The Agreement contemplates that d.igEcor will have an irrevocable and exclusive right to market the digEplayer without interference from e.Digital.``...

Please NOTICE:...

They do not claim that there is an AGREEMENT that EDIG will not market any products using their own technology...

There is a universe of interpretation in what an agreement

would ``Contemplate``...

What BOW seems to say is that for $25000 dollars EDIG gave away their right to market any product that uses their technology which could possibly be a competition to digEplayer which EDIG had made for BOW...

Nonesense... I see nothing of the sorts in the agreement to provide the 1250 digEplayers to BOW, nor do I think RP is that stupid to sign such an agreement. Everything RP has done or said thus far on this ssue has been that EDIG was free to do wa they wanted with their IP, and digEplayer had no claims on the technology and they just owned the outside and te name...
