regarding digEcor mucking the Maycom deal: What if digEcor, in reality, had no customers for those 1,250 digEs? They had the money to place the order, make progress payments (for product, or for Maycom to blow-off EDIG`s contract?), setting up the current situation with very little real impact, if any. They sue EDIG with hopes of getting all their money back (including the Maycom pay-off to not perform).

So, IF EDIG could somehow prove that digEcor had no immediate customers for those 1,250 digEs, this theory could have legs. But digEcor could claim that they were just building inventory - though that argument would be weak if Triad is ``close``.
