You`re missing the point.... The point being that, assuming my thoughts are correct based on info from RP via Sunpoop (that digEcor made a direct payment to Maycom), the suit IS NOT about the Maycom 1,250, but about something else. That is, digEcor would be a party in the contract between EDIG/digEcor and Maycom, and therefore would have privity of contract, and therefore should sue Maycom directly as opposed to suing EDIG (because EDIG, as ``same side`` partner in the contract would NOT be the party causing injury - Maycom is the party causing injury). EDIG would not be involved at all, as EDIG was not injured (they got paid by digEcor) and EDIG did not cause the injury.

SO I surmise that the suit is about something else - perhaps the ``loosey-goosey`` digEcor IP. Doni has addressed this, suggesting that such a suit would be without merit (it would be about EDIG`s eVU infringing digE IP).
