Its amazing to me how some claim to be a sole voice of reason as they spew on about things we all know. Of course there are many things we do not know ... things we can't be certain of and regardless of who speaks we know that the fact is nobody knows.

In these cases we use various resources and attempt to find the most reasonable interpretation. This of course is skewed by our own personal values and judgments at times making the process more difficult that if we could indeed be completely objective.

When I consider the possibilities as I have with a couple of posts the first of which was amusing assertions, in which I tried to objectively lay out the knowns and unknowns (quite popular it seems ... thx) and a follow-up which was re-amusing assertions in which I speculated on what is indeed the best arrangement for all the shareholders I made an attempt to detach my self from my own situation and put myself in the shoes a complete outsider and then of those who are in control of the decision making process.

We all know both our legal system and securities regulations are lax ... in my experiences I have found those who are attempting to violate laws or rules attempt to do so surreptiously. Rarely have I seen a case in which those attempting to break a law look for a police escort.

LOOK in arranging court supervision have essentially asked for an escort so there can be no one challenging the arrangement of the disposition of assets. This reduces the potential attempts to lay claim to the assets or to prevent the final arrangement from occuring.

There are some like myself who have speculated that the big 3 were attempting to wait LOOK and UBS out until they went bankrupt. Indeed in these perilous times and potential for continued economic peril ... the continuation of business by LOOK is likely to be increasingly tenuous. It is far better to exit from a position of strength then wekaness so this is an opportune time to exit.

Bringing the court into the process assures both the sellers of the company of a "police escort" and also potential buyers that the assets LOOK is selling can be transferred unencumbered.

I know there are those who think the courts are purely a rubber stamper and that the idea of a "police escort" and just another way of fooling the unsophisticated and unsuspecting shareholders and of course that is possible.

BUT

Is that a reasonable

Again I will simply attempt to put myself in Dolgonos and McGooey shoes ... and look at possible motivations

1) desire for a high profile job in one of the companies ... not likely .... given the auction value of spectrum they could have sold it at much less than market price and assured them a multi million dollar contract as VP of strategic vision and director of infrastructure potential ... and do nothing or something

2) attempt to transfer the assets to a wholly owned private company ... more probable ... given this is infrastucture and requires very deep pockets to realize its value ... they would need a lot of additional capital to make this fly and could never find investors given a dubious past ... also I personally wouldn't do it under the light of the courts, and I think I could have drained the resources of LOOK and UBS such that my private company would be able to negotiate a deal to acquire the assets at fire sale prices.

3) sell the assets ... maximize the return and buy an island ... ok ... some other people are going to make above avg returns and although some may prefer cash some shares of the new company whatever .. they will all do well.

I love the courts involvement ... there can be no objection or later attempt on the part of the usual suspects to undermine the process ... IMO that has been their objection for some time and they have done everything possible to prevent ownership from realizing fair value for the asset ... this time they can not stop the process and it is done completely in the light of day escorted by police.



One last thought ... when I consider information and credibility I think of motivation above all else ... mine is simple ... i think we got a winner and I want those honest long suffering holders of this company to realize maximum dollar. I hope I do as well.

At the end of day ... call me a fool but I have far more trust in a court supervised process in which getting top dollar for the investement benefits the decision makers most of all then any poster on any site selling you snake oil.

Reason and common sense dictates that.
