Court of Appeal hears arguments in MATL case

A panel of three justices of the Calgary Alberta Court of Appeal announced Friday it will release its judgment on an appeal of a portion of the routing of the proposed Montana Alberta Tie Ltd. power transmission line linking Lethbridge and Great Falls as soon as possible.
Presiding Justice Connie Hunt and Justices Carol Conrad and Clifford O’Brien heard arguments in the morning from a group of Coaldale-area landowners who feel the Alberta Energy Utility Board failed them when it did not approve a route with less impact on irrigation farms.
Their main point was the EUB should have overruled a previous route corridor approval issued by the National Energy Board.
The appellants also argued the merchant transmission line, built to move electricity north and south, is a for-profit venture and is not in the public interest definition.
Two MATL lawyers argued the same issues — one on public interest and the other on the EUB-NEB issue. A third lawyer presented the EUB position.
Shael Galfand of Calgary, a communications spokesman for MATL, said the day was a good example of legal process.
“Without prejudging the court, the company will wait for the decision,” he said. “MATL will not start any construction until the decision is released.”
