The following comes from an affidavit by Dan MacDonald sworn February 27th 2009 and attached to Challenger Energy's Court Application for protection under the Companies Creditors Arrangement Act (CCAA) for bankrupcy protection. On page 8 Dan MacDonald states:

30. CSEI has appealed the Order appointing the Interim Receiver of the Alberta Court Of Appeal (the "Appeal"). CSEI has also made application to the Alberta Court of Appeal seeking a stay of the Order until such time as the Appeal has been heard. The stay application was heard by the Honourable Madam Justice Conrad on February 23, and February 24, 2009. At the conclusion of argument Madam Justice Conrad granted a 48 hour adjournment of proceedings. Argument with respect to the stay was concluded on February 26, 2009, with a decision on the stay to be released at 11.00 a.m. on February 27, 2009. The Appeal is set to be heard on March 10, 2009.
