Listen- Bissell and New Vision don't own ANY of the claims. Their portion of the claims was sold to GHDC, with them retaining shares but no claims or parts of them. This is from the 2010 10K:
"GoldLand is not the sole owner of seven of the patented claims that we lease from GoldLand, and instead owns only 29.166% of the claims. The remaining 70.834% of the patented claims are owned by a large number of descendants of the original parties that obtained the patent rights to the mining claims. We are in the process of trying to identify and acquire or lease the remainder of ownership of these mining claims."
NV/Bissell don't own the remaining 71% and never did, it has always been owned by unknown heirs of the original owners.
I'm not sure whether SFMI controls 100% of the claims the waste ore is coming from. I hope so. And I'm not sure whether GHDC gets 15% from the waste ore, either. The terms specify 15% of revenue from mined ore, but that could be interpreted as only ore mined by SFMI, or also including previously mined ore. I think RK has said that the waste ore is not subject to the 15% to GHDC, but maybe that should be checked again.
Not sure what Kinross did or knew about the rights of the unknown owners. It may be why they mined the other mountains first.
