I think the extension is a formality, not a failure to file. Like asking for an extension on your taxes- perfectly allowable, but doesn't relieve you of the responsibility to file (or any extra interest that may pile up). Besides, it only gives them an extra 15 days. Not much time, really, though excruciating to investors.
