Hey SF, I believe those actions are around statements made by Esperion in mid 2015 to the effect that that Esperion might not have to do a CV outcomes trial which if true would have chopped significant time to market for Esperion.
Interestingly the ESPR share price is higher than the share price at the period in question. Despite the legal action, and to my points, ESPR still has reached a market cap of $2.1B USD. Further, if you look at ESPR share price in the last year it is up 600+%, the same can not be said for RVX. The biggest difference to me is in the quality of business management between the two companies.
