I read in the filings that when accepting Eastern's gaurentee of the loan, with the company putting pretty much all their intelletual capital as security for Eastern's gaurentee....it said something about great care having been taken to determine whether Eastern was acting in the capacity of a shareholder or that of a service provider....providing the service of gaurenteeing the loan in this case. The determination was made that they were acting as a shareholder....
Okay....but.
Oh to be in Eastern's shoes at this point. Apabetalone, I think we all agree, has the potential to be worth billions in of itself. But does it have to be Resverlogix that takes Apabetalone to the finish line? If you're in Mr. Dart's shoes....if Resverlogix takes it to the finish line, then you win big as a major shareholder....But if Resverlogix fails because they're unable to satisfy the loan obligation....then Eastern gets pretty much everything, including the patents related to Apabetalone as near as I can figure....And then he can peddle it to the Pfizer or any other BP player....or licence it out I would guess.
That's why I was hoping they'd raise enough $$$ to retire the debt entirely....If I was Don I'd be on the phone to Ottawa to see if there isn't some development grant type money out there, anything. The Feds just gaurenteed 100s of millions of loans to Bombardier, and then voted their BOD million dollar bonuses.....$70 million is chump change to a government running deficits in the tens of billions.
Grasping at straws....yeah, maybe. But the deal the company made with Eastern might have been a deal with the devil I'm starting to think.
