Financing closes November 2nd

Question about closing. Is the company allowed to announce if the financing has closed prior to the date indicated November 2 in the latest news release or are they bound legally etc to not say anything before the date given? I would suspect it would be something they would want announced if fully subscribed and spoken for, so as to eliminate any speculation about it not getting fully allocated.
