Not a lawyer nor engineer but, any NRE would have an economic transaction associated with it and those numbers would be disclosed in the financial statements. If it were material in amount, the M.D. & A. would most certainly require disclosure of details. Having said that, disclosure of the related party to an NRE may be exempt from M.D. & A. disclosure by way of a NDA. 

Personally, if we received a material NRE subject to conditional NDA but were informed of what it was for ie. VCSEL development, with a contingent licensing deal at the end, I would welcome that.
