It would seem that if POET agreed to do "custom fab" down to 100 nm for a specific potential license customer that some form of agreement would have to have been entered into with that customer prior to starting the work. That agreement probably would either: 1) pay for the cost and O/Hs to complete the work if POET were able to get it to perform acceptably at the 100 nm 2) have the potential customer's commitment to enter into a binding agreement and license upon completion of the 100 nm pilot
