from the BAE contract...
a) was always worried about who will pay the lawyers when it comes time for patent protection. Seems like BAE will step up if the IP is challenged.
b) BAE is the sole exclusive foundry for all military-use applications of POET for 6 years (until June 2014*), with an additional 3-year extention option (to June 2017). foundry exclusivity for commercial-use applications is not awarded to BAE (but it is not excluded).
c) 5% BAE-direct royalty to ODIS, plus 50% of sublicensed technology royalties, each for 15 years (thru 2023)
* dates would be the earliest, if using periods dating from 2008. if they are instead from time of commercialization, assuming a 2014 trigger, that would be 2023 and 2029, respectively.
