Wyloo vs Nov 9th

Nov 9 is fast approaching...

What happens if Wyloo and the BOD don't reach an agreement before Nov 9th (I've seen lawyers drag things out for months even for friendly negotiations), or if Wyloo declares they can't reach an agreement with the BOD (e.g. because they plan to fire them)?

Is the Nov 9th expiry of the BHP offer even significant anymore?
