Can BHP buy on open market?

I believe they cannot buy a controling interest but can buy 5% in the open market and must disclose this in the information circular they send out. Also, I believe, if Wyloo does come back with a formal offer it will be at that point they will see a copy of the formal valuation.  Thus at that time we will also see it.
