Good afternoon,
You are receiving this email because you have previously corresponded with the Impact Assessment Agency of Canada (formerly the Canadian Environmental Assessment Agency) regarding the federal transitional Comprehensive Study type Environmental Assessment (EA) for the Eagle’s Nest Project proposed by Noront Resources Ltd.
Today, August 28, 2019, the Impact Assessment Act (IAA) came into force, repealing the Canadian Environmental Assessment Act, 2012. IAA introduces a new and modern approach to the review of major projects and contains transitional provisions that will apply to projects subject to EAs under the Canadian Environmental Assessment Act, 1992 (the 1992 Act), such as the Eagle’s Nest Project.
As per the transition provision described in subsection 179 (1) of IAA: “Any comprehensive study of a project commenced under the 1992 Act in respect of which the former Agency has not, before the day on which this Act comes into force, published a notice under subsection 22(1) of that Act is terminated.”
On November 1, 2011, the Agency commenced a comprehensive study EA pursuant to the 1992 Act for the Project. The notice mentioned above was not published by the time IAA came into force, consequently, the comprehensive study of the Project is terminated. A Notice of Termination of the EA has been posted to the Canadian Impact Assessment Registry at https://iaac-aeic.gc.ca/050/evaluations/proj/63925
(Project Reference No. 63925).
The Project, as proposed, is not a designated physical activity as described in the Physical Activities Regulations (also known as the Project List) of IAA. Noront Resources Ltd. has been encouraged to consult the Project List and the Agency should they make any changes to their project design, to verify whether the Project is a designated physical activity under IAA. In addition, the termination of the comprehensive study under the 1992 Act does not preclude any other federal legislative, regulatory and constitutional requirements that may be applicable to the Project.
Information about IAA and the Agency’s Practitioners Guide are available at the following links:
The Agency appreciates your interest in the Eagle’s Nest Project EA. If you have any questions related to the above information, please do not hesitate to contact me.

Conor Anderson
