I wouldn't at all assume this. Not at all. It all depends on how the EA is submitted, whether FN's and government were a part of it. I think everyone will be pleasantly surprised.

Yes. One would hope that negotiations have been taking place with appropriate FN's for some time now during the creation of the EA, to mitigate unforeseen headaches during the review process.
