Be certain that KWG's lawyers take good note of all that is said around this road project. Notice that Cliffs is -understandably- kind of mute at this time, and the only voices heard are govermental or native! KWG's main argument before the Land Commissioner will be that a private party may not be allowed to "expropriate" his co-partner property (the RR surface rights) for its own exclusive interest (Black Thor), and letting the said partner dry out, waiting for their common interests (Big Daddy) to be developped when the majority partner decides so... The Commissioner will perhaps allow the easement, but the Cliffs application and the Commissioner decision itself will probably serve as evidence in a future civil action by KWG against his disloyal and greedy partner Cliffs. Unless Cliffs decides to take KWG over and go ahead. I think they may prefer to do this quickly, in order to clear the mud and try to avoid a chain reaction... First Nations (which have recently jumped in the easement procedure) have skilled lawyers already on the war path... Environmentalists may also be waken up by the clatter... GLTA. BaBe.
