This is a good discussion regarding the withholding of what some might consider material information.

I believe that your explanation is 100% correct....especially this part which is worth repeating..."according to their own interpretation of the best interests of the company."
I guess sometimes what they interpret to be the best interest of the company may be interpreted by others to be in the best interest of themselves and the institutional investors.
Now, it is certainly hard to prove who knew what when. For instance, when offering PP's and stock options; what was known by who at that precise time. I have made it known on more than one occassion my displeasure with the way they handled the announcement of hole 49, which was followed very shortly after with stock options.
And that brings your other point into the discussion, which also warrants repeating...."The only legislative concern is that they keep the information confidential until such time as it is generally released (as by news release)." Again, we can go back to the handleing of hole 49, where vague information was released, followed by stock options, followed a couple weeks later by a large run-up in the stock price on huge volume, followed by an announcement that there was nothing material to report, followed by a continued appreciation of the stock price, followed by the actual results to retail, followed by a constant decline in the share price.
I will say this as well. There is not one time that comes to mind that the stock price of this company has not foretold the news that was to come. In other words, the stock runs up before the good news arrives only to fall after the news, giving the impression of course that some were well aware of the news that was to come. In a similar way, the stock does tend to trend downwards fortelling of news that does not meet expectations.
These events certainly give the impression that some are profiting by insider information at the expense of others. However, despite how things look, it certainly does not appear that anyone has ever been charged with any wrongdoing.
So I am left with only one conclusion; and that is.....there certainly are alot of coincidences when it comes to the trading pattern of this stock.
