Would NOT have to announce in a PR if they had been buying up FWR shares in the open market the past few months?

I thought I recall reading where NOT would not be allowed to purchase more than 5% of FWR shares when this whole deal started, so would that imply that we can assume NOT owns 4.9% to tender to themselves?
