Shorting, as it has been done in the past on the uptick is not a problem. It is naked shorting and shorting to manipulate the sp downward that is what needs to be dealt with. If someone analyses the company's fundamentals and realizes that a stock is going to go down as the sp has been hyped due to speculation, then shorting on the uptick demonstrates knowledge and skill at trading and does not manipulate the sp. This is no different than one of us getting rid of some shares if we know something untoward is going on in our company. The difference is that in shorting the shares are borrowed to make some money with the knowledge and experience that the sp is going down.
