I`m not a lawyer, but Fish is not stupid. He knows he can be a pebble in the shoe to many of the paths to be traversed. Perhaps he`s working the nuisance angle for some hush $. He didn`t faire too well on the ownership issue, not sure how much cooperation he offered with B&O`s attempts, appears not enough to be a good boy and accept whatever life had dealt him at that point. So he`s baaaaaaaack.
In his mind he truly believes he can ripple the waters enough for it to be productive...his timing is pretty good, I`ll give him that much.
As to your first question, I would think he might have impact/opening if TPL and PTSC merged, or PTSC was bought out. maybe that`s one of the reasons TPL/PTSC remained separate. If he`s looking at it from another angle, I just cant see where he has advantage or opportunity.
Now as far as his intelligence in the legal arena.....I hope he`s a country bumpkin. We can always hope he oversteps his boundaries somewhere along the way and gets a taste of his own medicine. But thats a distraction that drains resources and capital dearly needed to fight current battles.
Maybe he just needs a job, but he`s going about it the wrong way, if so.
