Well, Patriot/TPL are claiming patent infringement based on the theory that every product utilizing microprocessors or embedded processors falls under one or all of the three patents they own. So, if this is true, no systems manufacturer has a product to use that would exempt them from possible patent infringement litigation.

Is it possible that PTSC wants to resolve the litigation prior to releasing product? Maybe, but I am not sure what the benefit would be. They own the patent wholly so any company using Ignite/Inflame would pay for it.
