Bean - I tend to disagree on how the Judge may view this. I would think that he would assume that all the parties had reason to believe that the other was acting in good faith.
It is kinda' like the book keeper who embessels money out of a company over a two year period of time and then gets caught. You would expect the owner to know that this was happening but they often times they don't. A judge may say you should have known this was going on but in the end the book keeper pays the price and is dealt with.
Remember that Lecky and his bucket of scum were brought in as the experts and it took a while to figure out that he was ganging the CORE and the MMP. This became very apparent when the Apple ageeement was disclosed. So much so that the Apple attornies, and others attorneys, started showing up at proceedings. My guess is that they may have been concerned with the 'co-mingling" of licenses...
