My feeling was that since "we" stipulated that Judge Grewal's about-face construction would result in non-infringement then unless Judge Chhabria overrode Judge Grewal we would have to appeal Judge Grewal's approach. The Oct 20, I think, document from Defendants laid out very clearly why they agrre with Judge Grewal. I just hope the BoD treat this with some high urgency.
