Hm, why would our side avoid a final ruling on the Kessler doctrine if we have a positive recommendation by the supporting Judge and a great possibility that Chabbria would follow this? Won't this hang over us as the sword of damocles because any other infringer can come up with Kessler again? I don't understand the rationale behind this step by our side.
