What's your thought on the Kessler ruling. I realize the ruling itself is difficult to predict, but if it were to go in our favor, do you see that as a tipping point per se? Since we've already prevailed in litigation in the same venue, to me it seems likely we'd prevail again, and thus, the companies would be inclined to settle v litigate, even if on the courthouse steps.
Or perhaps that's too optimistic, and these guys figure they've come this far, and they may look at the HTC ruling as the upper end of exposure, rather than the lower end. I'm not sure what to conclude, but at the least, it seems unlikely that we'd lose a trial if it's based on the same infringement issues that the HTC one was, which I suspect we would contend as much.
