As I see it, the ultimate outcome of the issue should be that ITC rulings can be considered as guidelines for the federal district court, but not as binding precedent. Otherwise, on most every occasion in which a district court matter is stayed pending an ITC outcome, such stays historically being fairly frequent, the power of a full-fledged district court will have been subjugated to that of a lesser federal forum.
