It depends on the dollars.
People wanting a ruling seem to overlook one thing: as far as HTC is concerned, a favorable ruling would have locked down that whopping $976K award from the jury trial. That's it. A ruling on obsolete products, and probably an obsolete chip.
A settlement and license would very likely be for all HTC products, past, present and future (until the patents expire). Much bigger dollars.
No PR yet, so only a few folks are even aware of this event.
If by some stretch of the imagination, PTSC is permitted to announce the value of this settlement, and that value is impressive, IMO it would have at least as much impact (on infringers, as well as the market) as a favorable ruling. Perhaps more so.
Perhaps others can opine (Ron?), but I would think that even a favorable ruling regarding obsolete products (and perhaps chip) could place PTSC in a position of again having to sue HTC regarding other products (which I presume were voluntarily dismissed WITHOUT prejudice).
As for the other infringers, it may be that a favorable ruling on obsolete products (and chip) could leave them open to argue that the chips they use are not exactly the same, and therefore litigation could continue.
I'm open to correction/other opinions - as always. But at the moment, I'm very happy with this settlement and believe this puts us on a better path for the future - more revenues faster.
