HMMMM

There are compelling reasons warranting a continuance of the upcoming oral

argument. The parties have reached, and are in the process of finalizing, a

settlement that will result in the dismissal of this litigation and obviate the need for

the pending appeal. The settlement is expected to be complete in late January 2015,
