This now means that the BK court will not invalidate the Alliasence agreement struck in 2012, where they took over the contractual obligations of TPL.
PDS remains the "Licensor" of the MMP.
Agility will "Prosecute" the patents.
Alliasence, and an as of yet unnamed other party, are the "Licensing Agents".
Alliasence now has additional financial "incentives" from licenses on top of their otherwise contractual compensation. I assume that PDS made this concession to Alliasence so that Alliasence would give up their PDS grant for having the "exclusive" Licensing Agent relationship with the MMP.
Mr Venkidu is now on the PDS Management Committee with Carl. Whether Mr Venkidu is taking DL's Seat, or is the 3rd Seat, we do not yet know.
*The original PDS Agreement specifically prohibited PDS BOD members from being paid by PDS, so some other arrangement or Terms modification has been made to compensate Mr Venkidu for his services.
This is just more indication that the TPL BK Reorganization Plan is agreed to in Principal; and will be presented to the Judge with all Parties asking him to bless it.
From a practical standpoint, this means little to the pending legal hurdles and historical weak Royality rate precedents the MMP still needs to overcome.
