The document on the PACER site is a PROPOSED order and is noted as such on the first page. It isn`t yet signed by the Hon. Jeremy Fogel (the judge in this case), but has been electronically transmitted to the court as what one might call proactive paperwork. If and when the court grants Patriot`s motion to allow Higgins to testify, the document will have Hon. Judge Fogel`s John Hancock prominently affixed. Until then, the document is simply a form waiting to be filled out.
