Obviously you missed a previous post of mine. I talked to the court clerk involved with this case. He stated that they do not scan their docs into Pacer. So while it was in the public domain, it was available only by going down to the courthouse. His words, not mine. So while I agree, people that obtained the doc have no obligation to share it, it HAS been shared amongst certain people. This is unarguable as people in Seattle, Las Vegas and California have all said they've seen it. And since you told me you didn't get it from Agora, please tell us where you got it from, because it wasn't governmental public access on the internet.

Now, having said all this let me say - I am not an aggrieved party. Had I known about the HTC appeal I admit I would not have done anything differently. In fact, I added shares recently due to the decline in SP. But when I read others stating that they would have liked to have known what was going on, and the attitude is tough beans, we had no obiligation to tell you, I take offense to that. Because if that is the case, I suggest some caveat when posting Pacers to the effect that people should get their own Pacer account and not rely on other posters to post this info. This warning should accompany EVERY Pacer posting so that posters are not lulled into thinking the info will always be there. And in fact, another tidbit that has been conveniently omitted is that hey should be warned that it takes about a week to get a Pacer ID and password. So even if someone suspected something and wanted to research the Pacer database on their own, they would have had to wait anyway.

And let me make one last comment. BaNosser isn't the only one with a Pacer account. In fact I have one. So go ahead and point the finger at me and say I should have posted something. Unfortunately I was out of town on a business trip from 2/24 - 2/26, with no internet access. So I couldn't have looked anything up even if I wanted to. But I find it very hard to believe that all of the other people with Pacer accounts here were totally unaware of the HTC appeal. Sure, Mark offered a sincere apology for missing the Pacer. EVERYONE MISSED IT??? Is someone pissing in our ear and telling us it's raining? The SP went from a close of 8 cents on 2/21 and was down to 6 cents by 2/26 and no one thought to check Pacer? On a 25% decrease in share value?

I'm done with this subject unless I need to defend responses to this.
