They cover different scenarios.
In my opinion only, I think the ITC carried more weight. This is based simply on the fact that if the ITC case would have been won, the supply of chips would have dried up. Instant pain.
On the other hand, the NDCA ruling is a good one, but it requires pursuing further potential infringers in court at a cost that will take some time. And now, with a conflicting ruling (we'll have to see what the ITC really said), potential infringers likely will be more reluctant to pay and there's a greater chance for an appeal to the CAFC with little chance for a treble damages relief.
The opposite of what has happened would have been a better outcome for Patriot since there is now continued uncertainty. An ITC reversal would have been a complete win.
