Here's the reality of things:

1. Win in NDCA.

2. Total loss at ITC.

There are now two different, inconsistent holdings. The Court of Appeals for the Federal Circuit (CAFC) is the court to adjuducate the difference.

Conjecture on my part:

My guess is that very few companies will just pony up at this point. And if one or two do, I can't imagine how low that settlement amount will be. Some party or other will likely appeal to the CAFC.
