I still don't agree. You said we had to file a complaint by expiration date to maximize our claim. IMO it is more important that we have fulfilled the notice requirements rather than filed a complaint.

As an example - if we notify company A on 1/1/2011 that they infringe, but don't file a complaint until 2016 (after expiration) we will still garner the same exposure as if we filed prior to expiration.

If we take that same company and file a complaint on the last day prior to expiration, but have not sent notification prior to filing the complaint, company A would have no exposure IMO.

Your statement only holds true for companies that we notified six years or more prior to expiration date and for which we have not filed a complaint. Yes, those companies need to have complaints filed prior to expiration. However, for companies we have notified say from 2010 to present, it is not essential to get that complaint filed prior to expiration.

For companies we have yet to notify, or that we have notified in the last 2 years, getting the complaint filed prior to expiration is not a necessity at this point.
