As you know, hindsight is always 20-20. Given the outcome, clearly it wasn't a good move, but what TPL did was standard operating procedure. There are many cases like this one where a case is filed in both the district court and ITC and the district court proceeding is stayed pending the outcome of the ITC. I believe there is no legal basis for changing that order.
