I would think that Option 3 would essentially mean PTSC & TPL, rather than sue for infringement, would instead undercut one another in pricing to entice infringers to license.

Hence, considering TPL's antics over the last 5 years, and the unappetizing prospect described above, my choice for No. 2 as the best course.
