Your question does nothing to answer mine. From the posts on this thread it appears that varying will be the linchpin to the NDOC outcome. Hence the discussion was about varing and whether deminimus varing is infringement. I only interjected the argument that was made at the ITC to possibly aid in the discussion. It is not my argument, so please do ask me to defend it. By all means, please attack why that argument doesnot hold water. That is what I am looking for.
