"If we provide funding to PDS that is not reciprocated by TPL, our ownership percentage in PDS will increase and we will have a controlling financial interest in PDS, in which case, we will consolidate PDS in our consolidated financial statements."

This provision has always been in place, it is not new.

Keep in Mind that although PDS is operating under a "Going Concern", and it's the only revenue generator for our company's operations, only TPL and not Dan Leckrone has filed for BK.

I suspect that if things got ugly and TPL did not contribute to PDS, and if PTSC really looked like they wanted to trigger this provision, the PDS contribution monies would be put up by Dan Leckrone personally. My guess is DL took PLENTY of millions out from TPL before having it file for BK. Don't forget, I believe that DL and his kids are the largest creditors in TPL's BK.

I doubt PTSC will ever own more of the MMP than it's current 50% interest; not so long as there is the potential to license the patents within it.
