Giving it further thought, (and without any court knowledge), I would also find it highly unlikely a court would rule afterwards....

If we dare let ourselves assume for a second that the court does allow Higgins to testify...this significantly turns the tables for Patriot - as we discussed, the Bernier dismissal is curious. It may be Patriots intent in the dismissal to further signal to Intel, et al...a signal or an invitation to them to sit down and put together some intelligent #`s, maybe take a look at Patriots new `landscape` and see what can be worked out.
I do like the $billion figure that JW was knocking around. Realistic?....well....think of all the licensing fees Intel could collect from AMD, etc....they recoup their expenses here in no time flat.
If the cards are in our favor, I just hope Patriot doesn`t roll over too easily.
