This whole issue of what Chet is owed truned on the meaning of Gross MMP revs contained in the agreement. TPL said it meant after many other carve-outs and costs taken off the top. Thus, TPL could have numerous carve-outs and expenses sufficient to leave nothing for Brown. The court took issue with that interpetation. So the court said gross is the money paid to TPL or any of its assignees. And as the licensor of record for all those past licenses anyone, including PDS, that TPL instructs payment to be made to is an assignee (from the court's perspective).
I might be mistaken but I believe the licenseor is now PDS, not TPL. And the reason for that is to keep the amount owned to Brown as 3.5% of what TPL gets from the license, not what PDS gets.
