Yes he had to because of precedural law. We didn't didn't do enough in a timely manner to back up our motion. It was allowed because we didn't compel more discovery in a timely manner. The bottomline is it comes down to the very weak argument. I know it won't be decided here but I must counter the FUD of the issue.
