I alluded to the very same "flaw" you are talking about now. The judge has to buy what we are selling. All I can say to that is what Jim O has argued, and that is the ring oscillator generates a clock signal without relying on the external crystal within a range. Sometimes it appears to be controlled and at other times it appears to run free and the ring oscillator does not require an external crystal to oscillate, it does oscillate based on PVT, and then the reference signal occasionally controls it. Did you find any legal precedent where the case was similar to ours and infringement was required 100% of the time?
