One theory is that MSD denial was released so close to trial that the most of the money was already spent on the trial. Why not just go through with it at that point. IMO if we would have recieved the denial weeks in advance we would have had a few fold. Otteson said at the shareholder meeting that he thought the MSD would be an impetus for some settlements. We don't know what the settlement negotiation terms were and what the risk reward was for settling before trial. After we win the amount of a license should be very close to what VH Valuations says it should be. I still think if we win the next argument will be that we are a SEP. Not sure how that will affect the licensing amounts but it will put everyone on notice immediately.
