I also hope the MSD is denied in full. Otherwise, the judge is going through the products and denying the MSD on some and not on others. Or, he is writing the most solid opinion he can justifying why he will grant the MSD. Please be aware, according to folks based in the legal field, it is not uncommon for the judge to hold off on making his decision on the MSD until right before trial or during the trial. So I'm not sure I would put much stock in the preparation for trial and accompanying motions to determine the MSD will be denied. I think it is a good sign that the wheels of the court are still turning, but I will not rely on that circumstantial observation to say the MSD has been denied. Keeping my fingers crossed!
