James C. Otteson - Founding Partner Jim Otteson is the founder of Agility IP Law, a law firm dedicated to the delivery of the highest quality intellectual property litigation services in an efficient and cost-effective manner. He has over 20 years of experience in intellectual property litigation, including patent, copyright, trade secret and trademark cases in state and federal courts, as well as in the U.S. International Trade Commission (ITC). Before founding Agility IP Law in January 2010, Jim was the Head of ITC Litigation at the Silicon Valley law firm of Wilson Sonsini Goodrich & Rosati, where he practiced starting in August 1992. He also served as a judicial clerk to the Hon. Byron J. Johnson of the Idaho Supreme Court (1991-92).
Jim has particular expertise in the litigation and trial of complex patent cases, especially in the ITC. He has successfully tried multiple ITC cases for both respondents (accused infringers) and complainants (patent holders), and has litigated scores of other patent and intellectual property cases. He has also successfully briefed and argued multiple appeals in the U.S. Court of Appeals for the Federal Circuit, where he is undefeated.
Jim has litigated cases involving many technologies, including semiconductors, semiconductor packaging, computer hardware and software, nutritional supplements, biomedical devices, Internet and e-commerce, consumer electronics, mechanical devices, chemical products and footwear. Jim is an expert at distilling complex technical issues and making them understandable and compelling to judges and juries in the context of motions, Markman hearings, summary judgment and trial.
Michelle G. Breit – Partner Michelle Breit joined Agility IP Law in September 2011 as a partner. During over 20 years of practice, Michelle has represented companies and individuals, in state and federal courts and before the United States International Trade Commission, in complex intellectual property litigation, including in patent, copyright and trademark infringement actions, as well as cases involving claims of trade secret misappropriation and breach of confidentiality agreements. Michelle has represented clients in diverse technologies, including satellite communications and signal processing, semiconductor design and fabrication, and fire protection devices. Michelle has successfully taken clients through mediation and arbitration, temporary restraining orders and preliminary injunction hearings, summary judgment and trial.
David A. Caine – Partner David A. Caine joined Agility IP Law in February 2011 as a Partner. In over nine years of practice, he has handled numerous complex, high stakes intellectual property and commercial matters. He has represented U.S. and foreign clients in federal and state courts, as well as in arbitration. His cases have involved a wide spectrum of technologies, including semiconductor fabrication, semiconductor packaging, computer hardware, computer software, memory and logic circuits, medical devices and telecommunications. David has substantial experience managing cases, formulating and directing case strategy, developing technical claims and defenses, executing fact and expert discovery, and preparing cases for trial. He has argued numerous motions, and has examined witnesses at hearings, bench and jury trials. Before joining Agility, David was an associate at Wilson Sonsini Goodrich & Rosati.
Thomas T. Carmack – Partner Thomas T. Carmack joined Agility IP Law in March 2011 as a Partner. Since 2003, he has represented domestic and foreign high technology companies in state and federal courts, and the U.S. International Trade Commission. His practice has included all aspects of patent, trade secret and complex commercial matters involving computer hardware and software, life sciences, pharmaceuticals, semiconductor fabrication, electronic security, memory and logic circuits and design patents. Thomas has significant trial experience, including witness examination, and has argued numerous motions in both state and federal court. Before joining Agility, Thomas was an associate at Wilson Sonsini Goodrich & Rosati.
Philip W. Marsh – PartnerPhilip Marsh joined Agility IP Law in September 2011 as a partner. Mr. Marsh comes to Agility with more than thirteen years of intellectual property experience, including high-stakes patent litigation experience across a variety of technologies, such as computer hardware and software, semiconductor fabrication and devices, wireless telecommunications, optical computer storage media, solid-state memory devices, fiber optics, lasers, and optical amplifiers. In addition to patent litigation experience, Mr. Marsh has significant prior experience preparing and prosecuting patent applications directed to electrical, computer, and mechanical inventions, as well as advising clients regarding strategic patent portfolio analysis and development. He also has experience litigating trade secret, copyright, and trademark issues.
Before Joining Agility, Mr. Marsh was an associate at Skadden, Arps, Slate, Meagher & Flom as well as at Cooley Godward. He also worked his way through law school as a patent agent at Cooley Godward and Burns, Doane, Swecker & Mathis. Before attending law school, Mr. Marsh worked as a patent examiner at the U.S. Patent and Trademark Office,examining patents directed to business methods.
Brandon Baum – PartnerBrandon Baum has served as lead counsel in patent cases, patent licensing programs, mediations, and arbitrations, and has first-chaired numerous jury and court trials. He has litigated disputes involving such technologies as telecommunication devices (hardware and software), thin films, computer methods and software, microprocessors, smartcards, business methods, Java™, medical devices, cryptography and GPS devices. He also has extensive experience litigating business disputes, and has tried cases in federal, state and even bankruptcy courts. An AV-rated attorney, Brandon has tried numerous cases to verdict, and was an equity partner at two top Silicon Valley law firms before joining Agility.
Brandon teaches a course in patent litigation techniques at U.C. Hastings, and has lectured at Stanford’s Graduate School of Business and Santa Clara Law School. He is a court-appointed Early Neutral Evaluator and Mediator for IP cases in the Northern District of California, a Northern California “Super Lawyer,” and a regular contributor to PLI’s Patent Law Practice Center.
James Farmer – CounselJames R. Farmer joined Agility IP Law in January 2012 as Of Counsel. Since 1999, James has represented clients in complex Intellectual Property litigation before federal and state courts and arbitration panels, involving a range of technologies, including satellite communication equipment and methods, integrated chips and computer hardware and software, medical devices, fire protection and suppression equipment, automotive shock absorbers and high-power firearms. James also has substantial experience prosecuting U.S. and foreign patent applications, drafting opinions and license agreements and preparing due diligence investigations and analyses for corporate mergers and acquisitions. Prior to practicing law, James earned Masters and Ph.D. degrees in mechanical and aerospace engineering, and thereafter held post-doctoral fellowships at Princeton and Brigham Young University, specializing in the areas of engineering physics, fluid mechanics, and applied mathematics. James has substantial industry experience, including positions or collaborative efforts at David Taylor Model Basin, Office of Naval Research, General Electric Corporate Research and Development, Intelligent Aerodynamics, Inc. and NASA Ames Research Center.
Irvin Tyan – CounselIrvin Tyan is Counsel at Agility IP Law. Irvin’s practice focuses on the areas of intellectual property and commercial business litigation. He has successfully litigated cases in both federal and state courts, in the U.S. International Trade Commission (ITC), and on appeal to the Federal Circuit and Ninth Circuit, on behalf of some of the world’s leading information technologies and software companies, a computer game developer, brand name and generic drug pharmaceutical companies, a national defense contractor, an agriculture company, a music search engine, a television manufacturer, and several casino gaming companies
Prior to joining Agility, Irvin was an associate at Quinn Emanuel Urquhart Oliver & Hedges and Farella Braun + Martel. He also served as a judicial extern to the Honorable James Ware.
Irvin has appeared as a guest lecturer at Stanford University on legal ethics, and regularly appears as a judge at Stanford Law School for a course titled “Scientific Evidence and Expert Testimony in Patent Litigation.” At the University of Michigan, Irvin served as a teaching assistant in legal writing, criminal law, history, and chemistry.
Jedediah Phillips – CounselJedediah (“Jed”) Phillips is Counsel at Agility IP Law. Since 2001, he has represented domestic and foreign technology companies in intellectual property disputes before state and federal courts, the U.S. International Trade Commission, and the International Centre for Dispute Resolution. Jed’s practice covers a wide range of technologies, including computer architecture, manufacturing and software, as well as life sciences, biotechnology, and robotics. In addition, Jed has represented clients in complex matters involving a wide range of substantive business litigation issues, including antitrust and unfair competition claims, trade secrets and licensing and contract disputes. He has extensive experience managing complex cases in multiple forums, conducting fact and expert discovery, and all aspects of trial preparation. John Downing – AssociateJohn Downing joined Agility IP Law in September 2011 as an associate attorney. John started his practice in the Silicon Valley where he represented some of the most innovative companies in the world. His practice primarily focuses on patent litigation including representing clients in state and federal courts and before the United States International Trade Commission. John has experience with numerous technologies including satellite communications, telecommunications, semiconductor fabrication, electronic components, mechanical medical devices, computer systems, and biotechnology.
Vincent Kenman Yee - Director of Ops/ Sr. Case ManagerVincent is the Director of Ops/Senior Case Manager at Agility IP Law. Vincent’s background encompasses over 25 years of legal managerial/paralegal experience in intellectual property litigation. Before joining Agility IP Law, Vincent worked for 7 years as Director of Litigation Administration at Broadcom Corporation. He managed all aspects of in-house electronic document collection and discovery for a series of large patent infringement cases between Broadcom and Qualcomm. Vincent has extensive experience in the management of large complex litigation and the preparation of cases for trial. Additionally, Vincent’s experience includes M&A due diligence and documentation.
Prior to Broadcom, Vincent spent 10 years at the Silicon Valley law firm of Wilson Sonsini Goodrich & Rosati as a Litigation Manager, and 8 years as a Case Manager at the San Francisco law firm of Bronson Bronson and McKinnon.
