Apparently references are made in various filings as to PDS financials. The question arose as to whether anyone would be testifing at trial regarding PDS books. We belatedly tried to get Gloria added for this purpose. So not going to happen.

Since both sides were agreeable to the motion, I suspect the rationale from the point of view of the ALJ is - what import does this have as to whether or not respondents infringe on the 336? NONE. Hence, NO to the motion.

I don't see it as positive or negative for either side. Just not important.
