Many differences such as TPL has a successful licensing business - ~100 licenses. They attempted to build processors as did PTSC. Plus, many of the companies being "sued" in the ITC are not domestic companies. Another difference is the USPTO has essenially secured the validity of the patents, which I suppose X2Y has not gone through the ITC? X2Y still has the opportunity to go through the USPTO and have the patents reexamined and sue in district court. TPL via planning or serendipity sued in district court, got a positive Markman, went through several PTO reexams, got two more favorable Markmans, licensed 100 companies... I'd have to think the body of work is probably 7 to 8 years more solid in terms of going throught the aforementioned processes.
